 The 28th House of Delegates District Democratic Nominating Committee has cancelled the Unassembled Caucus scheduled for May 21, 2017. Joshua G. Cole was the only candidate to file and he will become the Democratic Candidate for the 28th House of Delegates District. He is an Assistant Pastor at the Union Bell Baptist Church in Southern Stafford County. He also serves as a behavioral aid for students in the Richmond Public Schools system.

CALL TO CAUCUS TO NOMINATE A DEMOCRATIC CANDIDATE

for the Virginia House of Delegates for the 28th District

May 21 2017

The 28th House of Delegates Democratic Nominating Committee will hold a combined Stafford County and City of Fredericksburg unassembled caucus (firehouse primary) on May 21, 2017, between 12:30 and 4:00 PM at the Berea Fire Station at 20 Sebring Drive, Fredericksburg VA 22406 in South Stafford County, for the purpose of nominating a Democratic Candidate for the Virginia House of Delegates from District 28 in the November 7, 2017 General Election.

  1. Candidate Filing:

Each person seeking to become the Democratic nominee for the General Election for the 28th House of Delegates District shall file a Declaration of Candidacy form with the 28th House of Delegates District Democratic Nominating Committee Chair and a $500 nonrefundable certified cashier’s check (cash or money order not accepted) made payable to the Stafford County Democratic Committee. This Declaration of Candidacy and the $500 Filing Fee must be received by Thomas W Kimbrell, Chair 28th House of Delegates District Nominating Committee, no later than Monday May 15, 2017 at 6:00 PM, either by mail or in person at 418 Collingwood Dr., Fredericksburg, VA 22405. Only those candidates who have timely and properly filed a Declaration of Candidacy form and paid the filing fee will have their names placed in nomination. The Declaration of Candidacy form will be available on May 1, 2017 from Thomas W. Kimbrell, Chair of the 28th House of Delegates District Nominating Committee. The form will also be posted on the Stafford Democratic Committee website: www.stafforddemocrats.org and the Fredericksburg Democratic Committee website: www.fredericksburgdems.org .   1. Qualification of Candidates:

The Declaration of Candidacy form, which the candidate must sign, will include a written declaration that the candidate:

  • Is a Democrat and not a member of any other political party;
  • Meets all requirements of state law to be placed on the ballot for the General Elections;
  • Is eligible to be the Delegate for the 28th House of Delegates District under the laws of the Commonwealth of Virginia;
  • Does not intend to support, endorse, or assist any candidate who is opposed to the Democratic nominee in this General Election;
  • Will not participate in the nominating process of any other political party for this General Election; and
  • Agrees to abide by the Caucus Rules, the Virginia Democratic Party Plan, and all laws applicable to this nominating process and the General Election.

III. Notice:

This call to caucus will be posted on the Stafford Democratic Committee, the Fredericksburg Democratic Committee and the Democratic Party of Virginia websites and emailed to the members of the Stafford and Fredericksburg Democratic Committees. A press release will be provided to Fredericksburg and Stafford County newspapers.

  1. Participation:

Every Democrat who is a registered voter in the 28th House of Delegates District is urged to attend and participate. Each participant must sign a written declaration that he or she:

  • Is a Democrat and not a member of any other political party;
  • Does not intend to support any candidate who is opposed to a Democratic nominee in this General Election;
  • Has not participated in and will not participate in the nominating process of any other party for the positions listed above; and
  • Is registered to vote in the 28th House of Delegates District.
  1. Affirmative Action:

It shall be the duty of each local Democratic chair and the members of each local Democratic Committee to take all feasible steps to encourage broad participation in the selection process.

Discrimination on the basis of race, sex, age, color, national origin, religion, ethnic identity or economic status in the selection process is prohibited.

  1. Conduct of Caucus

Voting will begin at 12:30 PM and doors will close at 4:00 PM on May 21, 2017. Those in line at the 4:00 PM closing time will be permitted to vote.

The Chair of the Nominating Committee, or his or her designee, shall be the Chair of the Caucus and shall appoint a Secretary and such other Officers of the Caucus as is deemed appropriate. The 28th House of Delegates Democratic Nominating Committee will prepare the Rules for the Caucus.

VII. Determination of Nominee:

If more than one candidate files for the Democratic nominee for the 28th House of Delegates District by the deadline, the candidates will be listed alphabetically on the ballot and will be elected by a plurality of the votes of the unassembled caucus.

If only one person files properly to be a candidate, the 28th House of Delegates District Democratic Nominating Committee may cancel the caucus and declare that person the nominee. If no person files properly to be a candidate by the deadline, the Nominating Committee may cancel the caucus. If there is no filed candidate, or if the properly nominated candidate withdraws or dies, or if the caucus is unable or does not occur in the times and dates specified, the Nominating Committee Chair may, before June 13, 2017, convene the 28th House of Delegates District Democratic Nominating Committee to consider the nomination of a qualified candidate upon first filing with the Chair a Declaration of Candidacy form and paying the filing fee.

2017 CALL TO CAUCUS

FREDERICKSBURG DEMOCRATIC COMMITTEE

Pursuant to the authority provided by the Virginia Democratic Party Plan, the Fredericksburg Democratic Committee hereby calls an assembled caucus beginning at 12:00 PM on Saturday, April 22, 2017, at the Central Rappahannock Regional Library (1201 Caroline St). The purpose of the caucus will be to elect 7 Delegates and 4 Alternates to the First Congressional District Democratic Convention, to convene at 11:00 AM on Saturday, May 13, 2017, Walker Grant Middle School, 1 Learning Lane, Fredericksburg, VA 22401.

Fredericksburg delegates to the First Congressional District Democratic Convention shall elect twenty (20) Democratic State Central Committee members; consider resolutions; and conduct such other business as may properly come before the Convention.

PRE-FILING

Those persons wishing to have their names placed on the ballot at the Caucus as a Delegate or Alternate must file a certificate of candidacy with Jason Graham, Chair of the Fredericksburg Democratic Committee, PO Box 1261, Fredericksburg, VA 22402, no later than 5:00 PM on Wednesday, April 19, 2017, by mail or via email (must include your signature) at chair@fredericksburgdems.org. The application includes the name, address, phone number, and email address of the person filing. The certificate of candidacy may be downloaded here.

No slates of candidates shall be permitted.

A voluntary administrative filing fee of $30.00 ($20 to the First Congressional District Democratic Committee and $10.00 to the local committee) shall be charged to those wishing to file as a delegate or alternate. Local committees shall collect the entire voluntary filing fee.

All papers to be filed with the Chair of the Fredericksburg Democratic Committee shall be filed via mail at Fredericksburg Democratic Committee, PO Box 1261, Fredericksburg, VA 22402, or via email to chair@fredericksburgdems.org with the subject line ‘1st CD Call to Convention’. If filing by mail, it must be received by the deadline – no postmarks. All forms that require a signature must contain a valid handwritten signature.

Conduct of the Caucus

Doors to the caucus will open for check-in at 11:30 AM. Any person attending the caucus shall sign a standardized Caucus Participation Form stating that he or she is a Democrat; does not intend to support any candidate who is opposed to a Democratic Party nominee in the ensuing election; is not a member of any other political Party; has not participated and will not participate in the nominating process of any other Party for the 2017 general election; and is a registered voter and a resident in Fredericksburg and the First Congressional District. These forms must be filled out before participating in the caucus. At 12:00 PM, the doors to the caucus will be closed and no person may participate in the caucus except for those persons in line.

The Chair of the Fredericksburg Democratic Committee or his designee shall be the Temporary Chair of the Caucus and shall appoint a Temporary Secretary and such other Temporary Officers of the Caucus as is deemed appropriate. Until the adoption of the Rules, the order of the Caucus shall be determined by the Chair of the Caucus, subject to the approval of the Caucus participants, Robert’s Rules of Order, and the Virginia Democratic Party Plan.

If no more than 11 candidates pre-file by 5:00 PM, Wednesday, April 19, 2017, then the first 7 people who filed shall be considered elected as Delegate and the next 4 persons shall be considered elected as an Alternate to the First Congressional District Democratic Convention from the Fredericksburg Democratic Committee. In this case, the caucus will be hereby cancelled. Notice of Caucus Cancellation will be posted on the Committee’s Website: fredericksburgdems.org. This cancellation will be posted by 8:00 PM, April 19, 2017.

If more than 11 candidates pre-file by 5:00 PM, Wednesday, April 19, 2017, then an election shall take place by ballot. Nominations are not allowed from the floor. Only those who pre-filed will appear on the ballot. The caucus shall elect a total of 11 Delegates. The top 7 vote getters will be elected as a Delegate; and, the next 4 vote getters will be elected as an Alternate.
